Your Right of Cancellation (Distance Selling Regulations)

You have the right to cancel the contract without giving any reasons within two weeks. To exercise your right of cancellation you must give written notice to me by letter or email or return the items. The cancellation deadline starts at the earliest by receiving these terms. To meet the cancellation deadline it is sufficient to dispatch the cancellation or the items in time. The cancellation or return has to be adressed to:

Cancellation-Consequences

In case of an effective cancellation the received items and payments have to be returned and refunded. If you do not return the items as required or only in a deteriorated condition I may charge you a sum not exceeding the direct cost of recovering the items. (This is not aplicable if the deterioration comes only from checking the items as you would have done in a store). You can avoid this by not using the items you wish to cancel like an owner and refrain from doing anything that deteriorates the items' value. After having received the cancelled items I will refund you within 14 days. I regret that if the cancallation concerns a delivery-sum up to 40 Euros I cannot refund the return postage costs, for deliveries above that your return postage costs are refunded.

Returns

If you change your mind I am happy to accept a return within two weeks of the items' receipt. You don't have to mention any reasons, just let me know you want to return the items. In this case it is sufficient to dispatch the items you want to return in time. The items must be returned to:

Exclusion

The Right of Cancellation and the Right of Return are not aplicable for contracts concerning items that have been costom manufactured for you according to §312d Abs. 4 BGB

Data Protection:

According to § 28 Bundesdatenschutzgesetzes (BDSG) I would like you to know that the necessary data to fulfill our contract are processed and safed according to § 33 (BDSG) using a computer. Of course I will treat your personal data conficential and won't pass them on to third parties. At any time you can demand to know which of your data I have safed as well as demand that I correct or cancel the data. To fulfill your order I need some of your personal data (like your adress). By placing an order you accept that I safe this data, I will treat it with utmost care and not pass it on to third parties.

The author endeavors to observe the copyrights of the used documents (graphic, sound, video, texts...) in all publications, use own documents or licence-free ones. All brand- and trademarks and -names that are mentioned on my website or if need be protected by third parties are unlimited subject to the regulations of the valid copy- and ownershipright of the respective registered owners. By just mentioning them it cannot be concluded that brandmarks are not protected by third party rights! The copyright of published objects that are created by me remains with me alone. Copying or using such pictures, texts or other objects electronically or in a printed publication is not permitted without my written consent.

Terms and Consitions for Online-Contracts

§1 Validity

1.1 My offers and deliveries are carried out exclusively according to these Terms and Conditions. They are accepted at the latest by acceptting a delivery.
1.2 Written individual agreements take first place before these terms.

§2 Offer

2.1 My offers are always subject to alteration and not binding.
2.2 Minor technical or creative changes of descriptions in catalogs, on the website or any other publications are possible without concluding rights from it against me.
2.3 Errors and mistakes excepted.

§3 Contract

3.1 The completion of a contract is achieved by notice or delivery.
3.2 If an item is not available I can place it on backorder or refrain from the contract. I will carry the additional costs for backorder shipments. Written, printed or arithmetical mistakes on the website are excepted as well as minor changes in design, color or material.

§4 Prices

4.1 All prices are either in Euros or US Dollars as stated.
4.2 Your invoice does not include VAT as I am registered as a minor business (Kleingewerbe).

§5 Delivery dates and periods

5.1 I make every effort to keep the delivery dates and period that I give you, still they are not binding as long as anything else has been agreed on in written form.
5.2 Delivery delays due to higher powers and/or occurances that I'm not responsible for entitle me to delay the delivery date or refrain from the contract.

§6 Delivery/ Shipping

6.1 The method of shipping is at my discretion, usually that will be by the Deutsche Post (German Postal Service)

§7 Guarantee and Liability

7.1 Guarantee exists for 24 months starting from the moment of transition of risk.
7.2. If the items are not treated correctly, are changed or tempered with, guarantee ceases to apply.
7.3. The buyer has to let me know any defects immediately, at the latest one week after receipt of the item, in written form. Defects that couldn't be discovered within this period even by careful checking have to be made known to me in written form immediately after discovery.
7.4. In case of a defect the buyer must ship the item with suitable packaging so I can repair it
7.5. The buyer can request repair. Only if a repair is not possible other guarantee-rights can be asserted. A right of replacement for harms/damages of any kind, no matter for what legal reason, including follow-up damages resulting from unsatisfactory delivery are exceted unless the damage has been caused deliberately or highly negligent.

§8 Right of Cancellation / Return

8.1 The order will take effect only if it is not cancelled without giving any reasons within 14 days of receipt of the items. This period starts not before receipt of the items.
8.2 To be in time with the cancellation deadline it is sufficient to send the cancellation in time to Andrea Venschott, Kirchweg 8, 86510 Ried, Germany or by email at andrea@annikalilly.de.
8.3 The cancellation can be done within this period as well be returning the items to the above adress. It is sufficient to ship the item in time to meet the deadline.
8.4 In case of a cancellation I will refund your payments within 14 days of receiving the items.
8.5 In case of a cancellation you have to return the received items.
8.6 The buyer is obligated for compensation if he/ she cannot return the item or only in a deteriorated state and he/she is responsible for that, meaning negligence or deliberation.
8.7 The right for cancellation does not apply to contracts with costom made items.
8.8 Please return the items in mint condition including an invoice copy if possible. I regret that if the cancallation concerns a delivery-sum up to 40 Euros I cannot refund the return postage costs, for deliveries above that your return postage costs are refunded.

§9 Payment

9.1. As long as nothing else has been agreed upon payment has to be made in advance. German customers may pay by banktransfer, whereas paypal is the only possibility for me to receive payments from international customers.

§10 Place of Fulfillment, Court Jurisdiction and Aplicable Law

10.1 If you are a business customer Place of Fulfillment and Court Jurisdiction is 86510 Ried, Germany. For any other customers Court Jurisdiction is according to the legal regulations.
10.2. These terms of sale and any business connections will be subject to German law and the German courts will have jurisdiction in respect of any dispute arising from the contract.

§11 Partial Invalidity

11.1 Should some of these terms be invalid, void or contestable, they are to be interpreted or completed in a way that the intended economic purpose will be achieved as best possible; all other terms will remain untouched thereof. By analogy this also applied to possible gaps.
